This Refund Policy outlines the terms and conditions regarding refunds for transactions made through the EventEats platform (the "Platform"). EventEats is a two-sided marketplace connecting Customers with mobile food Vendors.
This policy is drafted in accordance with the Australian Consumer Law (ACL) and guidelines set by the Australian Competition and Consumer Commission (ACCC).
1. Vendor Subscription Fees
Vendors pay a subscription fee to be listed and access premium features on EventEats (e.g., the Launch Special or the Featured monthly tier).
- Non-Refundable: Subject to your rights under the ACL, subscription fees paid to EventEats are generally non-refundable. This includes situations where a Vendor changes their mind, fails to secure bookings, or chooses to cancel their subscription before the end of the billing cycle.
- Consumer Guarantees: You are entitled to a refund of your subscription fee under the ACL if there is a "major failure" with the EventEats Platform. A major failure occurs if the Platform is significantly fundamentally unfit for its stated purpose, is entirely inaccessible for an extended period, or cannot be fixed within a reasonable time.
- Cancellation: Vendors may cancel their recurring monthly subscription at any time through their account settings. Cancellation will prevent future billing, but no pro-rata refunds will be issued for the remainder of the current billing period.
2. Catering Deposits and Event Payments
EventEats acts solely as an intermediary directory. We do not process, hold, or manage deposits, final payments, or any financial transactions related to the actual catering services provided for an event.
- Direct Transactions: All payments for catering services are negotiated and transacted directly between the Customer and the Vendor.
- Refunds for Catering: EventEats cannot issue refunds for catering deposits or payments. If a Customer requires a refund due to a Vendor no-show, poor food quality, or event cancellation, the Customer must request the refund directly from the Vendor in accordance with the Vendor's own terms and conditions and the ACL.
- Disputes: While EventEats is not a party to the catering contract, we encourage Vendors and Customers to resolve disputes amicably. If a Vendor repeatedly fails to meet their obligations under the ACL, EventEats reserves the right to suspend or terminate their profile on the Platform.
3. How to Request a Platform Refund
