Welcome to EventEats. These Terms of Service ("Terms") govern your access to and use of the EventEats platform (the "Platform"), which connects food trucks and mobile vendors ("Vendors") with event organisers, venues, councils, and private customers ("Customers").
By accessing or using the Platform, you agree to be bound by these Terms and the Australian Consumer Law (ACL). If you do not agree, you must not use the Platform.
1. Role of EventEats
EventEats operates solely as an online directory and intermediary marketplace. We provide a platform for Customers to discover Vendors, request quotes, and manage enquiries.
- No Agency: EventEats is not a party to any catering contract, agreement, or transaction between a Customer and a Vendor.
- No Endorsement: While we collect and display compliance documents (such as ABNs and insurance), EventEats does not guarantee the quality, safety, or legality of the food or services provided by Vendors.
- Payment for Services: EventEats does not process deposits or final payments for catering services. All financial transactions regarding event catering must be handled directly between the Customer and the Vendor.
2. User Accounts and Responsibilities
To use certain features of the Platform, you must register for an account.
- Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated.
- Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Acceptable Use: You agree not to use the Platform for any unlawful purpose, to harass or abuse other users, to submit false enquiries, or to scrape or harvest data from the Platform.
3. Vendor Obligations
Vendors utilizing the Platform agree to:
- Maintain current and valid compliance documentation, including Public Liability Insurance and Food Business Registration, as required by local councils and state laws.
- Respond to Customer quote requests in a timely and professional manner.
- Pay the applicable subscription fees (e.g., Launch Special or Featured tier) as outlined on the Platform. Subscription fees are processed via Stripe.
4. Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law (ACL):
- EventEats is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or the services provided by Vendors.
- We are not responsible for Vendor no-shows, poor food quality, property damage, or any disputes arising between Customers and Vendors.
- We are not liable for Customer non-payment or cancellation of events.
- Our total liability for any claim arising out of these Terms or the use of the Platform is limited to the amount you paid to EventEats (e.g., subscription fees) in the 12 months preceding the claim, or the resupply of the Platform services.
5. Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied or imposed by the ACL which cannot lawfully be excluded, restricted, or modified.
6. Account Termination
EventEats reserves the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice or liability, for any reason, including but not limited to:
- Breach of these Terms.
- Fraudulent or deceptive conduct.
- Failure by a Vendor to maintain required compliance documentation.
- Repeated complaints from other users.
7. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Australia.
8. Changes to Terms
We may modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on the Platform or via email. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
